General terms and conditions

Last updated

These general terms apply to all rentals with Fartout Bahir Rent SARL (FB Rent). They complement the rental contract signed in agency. The English version is informative — the binding version is the French original.

Conditions to rent

  • Minimum age: 18 years
  • Valid driver's license held for at least 1 year
  • Valid ID: passport or Moroccan CIN

For the complete version of our terms, see the French page or contact us at contact@fbrent.ma. Translation to English is in progress.

3. Use of the vehicle

The renter agrees to drive carefully, comply with road traffic regulations and use the vehicle reasonably and in accordance with these rental terms. The following uses are strictly prohibited:

  • Carrying passengers for payment
  • Competitions and races
  • Unlawful activities
  • Roads unsuitable for vehicles and/or closed to the public
  • Any assignment of the contract, sale, mortgage or pledge of the vehicle

The vehicle must be kept closed and locked when not in use. Taking the vehicle across Morocco’s borders is prohibited.

4. Authorised drivers and accidents

Only drivers expressly named in the contract may drive the vehicle, except in exceptional circumstances (force majeure or certified medical reasons). All drivers must be at least 18 years old and have held a valid driving licence for at least 1 year.

Unauthorised driver: if an accident involves a driver not named in the contract, the renter alone is liable for all costs.

Accident report: we must receive the accident report within 72 hours of the accident. Otherwise, it is considered invalid and the renter is held responsible.

5. Security deposit

The security deposit equals the insurance excess for the category of vehicle rented. It may be provided:

  • In cash, in MAD only
  • By bank card through a payment terminal, exclusively in the main renter’s name

If the renter cannot provide the deposit, the contract cannot be concluded and the amount already paid is non-refundable.

6. Insurance excess in the event of a claim

  • At-fault claim: the excess is 20% of the vehicle’s value, capped at the security deposit
  • Alcohol-related claim: the excess is 100% of the vehicle’s value, without a cap. Insurance does not provide cover
  • Not-at-fault claim: the full deposit is released within 10 days after the insurance claim is closed

7. Fuel

The vehicle must be returned with the same fuel level as recorded in the contract at collection. If the level is lower, a charge of 20 MAD per missing litre applies.

8. Returning the vehicle

At the end of the rental, the renter must return the vehicle and its equipment in the condition recorded at collection. Any disagreement with FB Rent must be expressly noted in writing on the return condition report before signing. An independent, accredited vehicle expert may be appointed, with the costs borne by the party responsible.

  • Early return: no refund unless agreed in advance
  • Return to a different location from that agreed: travel and fuel costs plus an administration fee of 200 MAD
  • Return after the agreed rental period without explicit agreement: treated as a breach of trust; FB Rent reserves the right to take legal action

9. Fines and traffic offences

The renter is fully responsible for all fines, penalties and costs arising from breaches of road traffic or parking regulations during the rental. If FB Rent receives a fine after the rental period, we charge:

  • The amount of the fine
  • An administration fee of 200 MAD for each penalty processed

These amounts may be deducted from the security deposit or charged directly to the payment method provided.

10. Governing law and jurisdiction

These terms and conditions are governed by Moroccan law. Any dispute relating to the rental contract falls within the exclusive jurisdiction of the courts of Casablanca. The French version prevails. Translations into other languages are provided for information only.
